Demand & Energy Information System Online License Agreement
This Agreement constitutes a legal agreement between you, our Customer, and CenterPoint Energy, by which you, as Customer, will be provided access privileges to CenterPoint Energy's online Demand & Energy Information System via the Internet. You should carefully read the following terms and conditions before proceeding. In the event that you, as Customer, agree to the terms of use, then please proceed with registration for access to the online Demand & Energy Information System by completing the registration process located at the bottom of this page. Terms of Use: All use of CenterPoint Energy’s Demand & Energy Information Services ("DEIS") via CenterPoint Energy Internet World Wide Web pages is subject to the terms and conditions set forth below. Any access by a Customer to DEIS constitutes the Customer's agreement to abide by the following terms and conditions:

DEIS is owned and licensed by CenterPoint Energy. CenterPoint Energy retains all proprietary rights to DEIS. Upon completion of the registration process in which you, as Customer, accept the Terms of Use, CenterPoint Energy will and at such time does grant to Customer a nonexclusive, nontransferable, limited license to access DEIS via CenterPoint Energy Internet World Wide Web pages with CenterPoint Energy retaining all proprietary rights to DEIS. Unless earlier terminated for default, this license shall be for a term of one calendar year from the date of Customer registration and shall continue thereafter until terminated by either party by providing the other with thirty (30) days’ written notice of termination.
Customer should be aware that data within CenterPoint Energy’s "firewall" is only sent outside the "firewall" upon the customer setting up a Major Account for a third party, or by submitting a written request for the release of the information by the Customer. During the brief time that Customer’s data is in transit via the Internet it may not be secure from access by third parties. Customer acknowledges that Customer is aware of this potential, and by accessing the system, Customer agrees to assume any risk associated with third party review or use of the data.
Customer should be aware that according to the Public Utility Commission of Texas (PUCT) that CenterPoint Energy as a Transmission & Distribution Service Provider cannot require that the customer provide his/her name to access energy usage and demand data to his/her service address, but the customer is advised to provide this information to allow CenterPoint Energy to investigate questionable access. However, if a Major Account is requested as a special service, under the PUCT Code of Conduct mandates, CenterPoint Energy must ensure that the data be accessed by parties that are authorized by the customer, and will require that the customer provide sufficient information to identify the customer.
Customer agrees to utilize the appropriate password for access and not to damage or erase any CenterPoint Energy meter information. Failure to abide by this or any of the other Terms of Use shall entitle CenterPoint Energy to immediately suspend Customer’s password and to cancel Customer’s access rights.
This Agreement shall be governed by the laws of the State of Texas, and the sole jurisdiction and venue for any litigation arising out of this Agreement shall be Houston, Harris County, Texas.
NEITHER CENTERPOINT ENERGY OR ITS SUBSIDIARIES SHALL BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES ARISING OUT OF THIS AGREEMENT OR ANY BREACH THEREOF, WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE. THE CUMULATIVE LIABILITY OF CENTERPOINT ENERGY, AND ITS SUBSIDIARIES UNDER THIS AGREEMENT SHALL BE LIMITED TO THE AGGREGATE FEES RECEIVED BY CENTERPOINT ENERGY FROM CUSTOMER FOR USE OF DEIS.
